Arizona DUI Law
DUI is an unpopular crime in Arizona (and in all other
states). Federal, state and local agencies along with non-profit
organizations such as M.A.D.D. have put forth tremendous efforts
to minimize the risks associated with drunk driving. As a result,
Arizona DUI Law has become harsher. 1st offense and extreme DUI
convictions carry misdemeanor convictions while an aggravated DUI

DUI
ARS 28-1381
It is unlawful for a person to drive in Arizona under the influence
of drugs or alcohol when they are impaired to the slightest degree
or has an alcohol concentration of 0.08 or more within two hours
of driving. It is also unlawful for a person to operate a commercial
motor vehicle with an alcohol concentration of 0.04 or more.
Extreme DUI (BAC .15 or more)
ARS 28-1382
It is unlawful for a person to drive in Arizona under the influence
of alcohol with an alcohol concentration of 0.15 or more within
two hours of driving.
Aggravated DUI
ARS 28-1383
A person is guilty on an aggravated DUI if they commit a DUI or
extreme DUI while their driver’s license is suspended, have
a prior conviction within 5 years or have a person in the vehicle
under the age of 15 years of age.
